By accessing or using the services provided by Otter Tech ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

Otter Tech provides technology consulting, AI automation, CRM configuration, web development, and related digital services to businesses and individuals. Services may include project-based engagements, ongoing support agreements, and software integrations.

3. SMS / Text Messaging Terms

3.1 Consent to Receive SMS Messages

By submitting your phone number through any form, website, or verbal agreement with Otter Tech LLC, you expressly consent to receive text messages (SMS/MMS) from Otter Tech LLC. These messages may include:

Appointment reminders and scheduling confirmations
Project updates and service notifications
Follow-up communications related to your inquiry or service
Promotional offers and business announcements
Your consent is not a condition of purchase. You are not required to consent to receive text messages to obtain our services.

3.2 Opt-In

You may opt in to receive SMS messages by:

Submitting a contact form or inquiry form on our website
Texting JOIN to our business number
Verbally consenting during a consultation or intake call
Signing a service agreement that includes SMS communication consent

3.3 Opt-Out / Unsubscribe

You may opt out of SMS communications at any time by:

Replying STOP to any message you receive from us
Emailing us at chris@otternh.com with "Unsubscribe" in the subject line
Contacting us directly by phone
Upon receiving your opt-out request, we will send one final confirmation message and will cease all further SMS communications.

3.4 Help

For assistance, reply HELP to any of our messages or contact us at chris@otternh.com. Standard messaging and data rates may apply depending on your mobile carrier plan.

3.5 Message Frequency

Message frequency may vary depending on your service engagement. You may receive up to 20 messages per month related to your active project or inquiry.

3.6 Carrier Disclaimer

Otter Tech is not responsible for any delays or failures in the delivery of SMS messages, as delivery is subject to effective transmission from your mobile carrier. Message and data rates may apply.

4. Privacy Policy

4.1 Data Collection

We collect personal information including name, email address, phone number, and business details when you:

Fill out a contact or intake form
Enter into a service agreement with us
Communicate with us via phone, email, or text

4.2 Use of Data

Your information is used to:

Provide, manage, and improve our services
Communicate with you about your project or inquiry
Send service-related and promotional SMS/email messages (with consent)
Process payments and manage billing

4.3 Data Sharing

SMS opt-in data and consent will not be shared with any third parties, affiliates, or partners for their own marketing purposes. Message data may only be shared with mobile carriers and messaging aggregators as necessary for message delivery.

4.4 Data Retention & Deletion

You may request the deletion of your personal data at any time by contacting us. We will fulfill deletion requests within 30 days, except where retention is required by law.

5. Payment Terms

All service fees are outlined in individual service agreements or invoices. Payment is due upon receipt unless otherwise agreed. Otter Tech reserves the right to suspend services for non-payment.

6. Intellectual Property

All content, branding, code, and materials created by Otter Tech remain the intellectual property of Otter Tech unless explicitly transferred in writing to the client upon full payment.

7. Limitation of Liability

Otter Tech shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services. Our total liability shall not exceed the amount paid by you in the 30 days preceding the claim.

8. Service Modifications

Otter Tech reserves the right to modify, suspend, or discontinue any service at any time. We will provide reasonable notice where feasible. These Terms and Conditions may be updated periodically; continued use of our services constitutes acceptance of the revised terms.

9. Eligibility

Our services are intended for users who are 18 years of age or older and located in the United States. By using our services, you confirm you meet these requirements.

10. Governing Law

These Terms and Conditions are governed by the laws of the State of New Hampshire, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Hillsborough County, New Hampshire.
